We only collect Personal Data that is actively and voluntarily transmitted to us (e. g. for mobile or online ticketing, when applying for a customer card, participating in a sweepstake, or ordering from the MVV online shop) – we do not process any other Personal Data via the MVV website. Personal Data include, without limitation, email addresses, names, addresses, and phone numbers. The Personal Data transmitted is not passed on to any third parties unless necessary for the purpose it was originally transmitted. Unless stipulated otherwise in the following, the Personal Data is used exclusively for the purpose it was collected for. We guarantee that your Personal Data will not be used for advertising. We do not use any automated decision-making, including profiling, in accordance with Article 22 (1) and (4) GDPR.
Where the processing of Personal Data is based on consent (Art. 6 (1) lit. a or Art. 9 (2) lit. a GDPR), you have the right to withdraw consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before withdrawal in accordance with data protection legislation (Art. 7 GDPR, .Section 51 German Federal Data Protection Act (BDSG)).
You have the right to access the Personal Data concerning you (Art. 15 GDPR) and a right to rectification (Art. 16 GDPR) or erasure (Art. 17 GDPR) or to the restriction of processing (Art. 18 GDPR) or a right to object to the processing (Art. 21 GDPR) and a right to data portability (Art. 20 GDPR) in accordance with data protection legislation.
Below you will find a list of special regulations that apply to certain services and offers provided by MVV GmbH. By using these services or offers or checking the respective boxes (opt-in), you as the user explicitly consent to your data being used as follows:
MVV GmbH processes the data transmitted by a customer when placing the order for the purpose of processing this order. The legal basis for processing is Art. 6 (1) lit b GDPR. The recipients of this data are the employees of MVV GmbH responsible for processing the order. In accordance with commercial law regulations, the data will be deleted after a period of ten years. If this data is not provided, conclusion of a contract will not possible.
For dedicated rules on mobile online ticketing, please refer to General Terms and Conditions of Business Mobile and Online Ticket, Section 12.
To issue a customer card, the data submitted by the customer in his or her online application will be processed. This data is (where marked with *) required for issuance of a customer card, which is, in turn, mandatory for travelling on the student & apprentice fare. If this data is not provided, the product cannot be made available.
The Personal Data entered when completing the application form for a student & apprentice fare customer card is processed exclusively by employees of MVV GmbH for the purpose of the review, creation, printout, and postage of customer cards for student & apprentice fare as well as the validation of relevant state compensation payments and for sales statistics (number of items only) The legal basis for processing is Art. 6 (1) lit b GDPR; processing is required to fulfil a contract or for pre-contractual measures.
The data will be stored for as long as it is required for the purpose indicated; as a rule, the data will be deleted two years after the card was issued.
Data transmitted to MVV GmbH when sending a suggestion or a complaint is processed to handle the matter and is stored and evaluated in anonymised form for the purpose of quality assurance. The data is processed by employees of MVV GmbH. When the suggestion or complaint has to be forwarded to the transportation company affected for handling or clarification, the Personal Data submitted will be forwarded to the respective company, too. The user explicitly consents to this. The legal basis for processing is Art. 6 (1) lit a GDPR (consent). If this data is not provided, complaints or any other matters cannot be processed.
To protect against spam, MVV GmbH employs Google Inc.’s (“Google”) reCAPTCHA service. This service includes sending to Google your IP address and, if required, other data requested by Google for its reCAPTCHA service. Different data protection rules apply for the Google corporation. For more information on Google Captcha’s data protection guidelines, see www.google.com/policies/privacy/.
If required, matters brought to our attention without using the contact form will also be forwarded to the transportation companies affected for handling or clarification; again, the Personal Data submitted will be forwarded, too.
As a rule, this data will be deleted twelve months after processing.
When ordering MVV brochures on the internet, the data submitted by the person placing the order will be processed by employees of MVV GmbH to handle the order. The legal basis for processing is Art. 6 (1) lit f GDPR. The legitimate interest of MVV GmbH, the transportation companies, and relevant stakeholders in public transport is the distribution of information material (free of charge) to increase the number of people using public transport instead of other means of transportation. If this data is not provided, it will not be possible to place an order. The data will be deleted two months after the material was sent.
The MVV Partner Platform is a data exchange platform for employees of transportation companies and relevant stakeholders in public transport. The data entered during registration is used by employees of MVV GmbH for verification during registration and features related to the MVV platform. The data is not processed for any other purposes. The data is not passed on to any third parties unless necessary for the purpose it was originally transmitted. The legal basis for processing is Art. 6 (1) lit f GDPR. The legitimate interest of MVV GmbH, relevant stakeholders in public transport, and the transportation companies is the smooth communication of information relevant for employees of transportation companies and relevant stakeholders in public transport as well as MVV GmbH in their day-to-day business. The Personal Data of the registered person is deleted once the person has unregistered or was removed. If this data is not provided, it will not be possible to register.
Other than short temporary storage for technical reasons within the framework of IP-based communication and when using one of the ticket shops to purchase MVV online tickets, no Personal Data is processed for requests via the MVV Journey Planner and the MVV Cycle Planner When using one of the ticket shops provided to purchase MVV online tickets, Personal Data is processed in accordance with the data protection guidelines applicable for the respective ticket shop. The regulations for the sale of mobile and online tickets via MVV GmbH’s ticket shop can found in Section 12 of the General Terms and Conditions of Business and Data Protection Guidelines.
For travel information and journey planning requests, the following data will be stored on the end device: a history of recently used locations, routes, and lines of transport, settings made, downloads (e. g. orientation maps, network maps, and timetable pages), server content received (map sections, travel information), and cookies required for technical reasons as specified below.
For secure operation, calculations made within the framework of electronic journey planning (departures, travel information, etc.) are logged on the journey planner servers. These logs exclusively track the calculations made and comply with MVV GmbH’s data protection guidelines No Personal Data is transmitted or stored; it is not possible to identify a user or a request pattern.
If the user enters an email address, it will only be stored temporarily for technical reasons and will automatically be deleted once the travel information was sent; it will not be processed for any other purpose. The legal basis for processing is Art. 6 (1) lit f GDPR with the intention of providing our users with improved access to public transport.
MVV Journey Planner and MVV Cycle Planner use so-called functional (i.e. technically necessarry) cookies. These Cookies allow for the recognition and temporary storage of information including language settings or a preference for our mobile journey planning portal. In addition, the cookies set optimise the processing of your travel information requests within our server infrastructure (so-called session cookies). No Personal Data is collected or passed on when doing so.
To improve the quality of our Journey Planner, MVV GmbH and/or IT service providers also generate anonymous usage statistics as per server requests. The sole purpose of these statistics is product improvement. They do not contain any Personal Data. MVVJourney Planner and MVV Cycle Planner do nout use any tracking or advertising cookies.
In MVV’s mobile journey planning portal, you can use your location for travel information requests. To use this feature, you have to explicitly consent to the usage of location services in your browser. This data will be used to identify waypoints on your routes as well as stops, stations, and upcoming departures in your vicinity. Location data will not be stored permanently or passed on to third parties.
Based on the information provided by you, a code is developed to allow for the integration of the MVV Journey Planner into your website. This data is not stored permanently, but will be deleted after your request was completed. There is no Personal Data involved in this process, seeing as this process does not store any IP addresses, for example.
All documents sent to us within the framework of a job application process will be reviewed to decide on further use. The legal basis for processing is Art. 6 (1) lit b GDPR; such processing is required for pre-contractual measures. Six months after the applicant was declined, they will be deleted (paper documents will be shredded) unless agreed upon otherwise.
The data you submit is used for the sole purpose of the respective project. The data is not passed on to any third parties. It is rendered anonymous before processing, and it is not possible for us to identify individuals. Once the project has been completed, the raw data will be deleted, and it is no longer possible to identify individuals in any way.
As part of our sweepstakes, we process personal data that you voluntarily provide to us (e.g. name, e-mail address). This data is used exclusively for the purpose of running the competition and notifying the winners. For deviating regulations, please refer to the conditions of participation of the respective campaign.
Your personal data will be processed on the basis of your consent in accordance with Art. 6 para. 1 lit. a GDPR. Your data will only be stored for the duration of the competition and for subsequent notification of winnings. The data will then be deleted, unless statutory retention obligations prevent this.
Your data will not be passed on to third parties and will not be used for advertising purposes.
You have the right to withdraw your consent to data processing at any time with effect for the future. The revocation can be sent by e-mail to datenschutz(at)mvv-muenchen.de. After revocation, your data will be deleted, unless there are statutory retention obligations.
You do not necessarily have to agree to the anonymous statistical analysis of the app data in order to take part in the competition.
MVV GmbH uses the data transmitted by you for the sole purpose of mailing the newsletter. The data is not passed on to any third parties. The data is rendered anonymous and used by employees of MVV GmbH for the sole purpose of statistically analysing newsletter mailings. The legal basis for processing is Art. 6 (1) lit a GDPR (consent). Once you unsubscribe from the newsletter, your data will be deleted. If this data is not provided, it will not be possible to send out the newsletter.
Sale of MobileTickets through the Ticketshop of MVV GmbH (Web2Wallet)
General Terms and Conditions of Business and Data Privacy Principles
1. General provisions
(1) These General Terms and Conditions of Business shall apply to the purchase and use of MobileTickets through the ticket shop of Münchner Verkehrs- und Tarifverbund (hereinafter referred to as "MVV GmbH"), which trades in the name and on account of the transport company Busbetrieb Josef Ettenhuber GmbH. They supplement the "General Terms and Conditions of Conveyance, Tariff Provisions and Fares" of the MVV common fare system for the Greater Munich Area (MVV-Gemeinschaftstarif), as amended. The German version of these General Terms and Conditions of Business shall be pertinent.
(2) In order to process the e-Payment services (e.g. webshop, mobile app) MVV GmbH uses the services of the IT service provider Digital H GmbH, Oststraße 55, 40211 Düsseldorf, as well as the financial service provider LogPay Financial Services GmbH (hereinafter referred to as "LogPay"), Schwalbacher Straße 72, 65760 Eschborn. For this purpose, any personal details required in order to fulfil the contract are forwarded to the service providers specified.
(3) The payment due for the MobileTickets shall be processed by LogPay, to which all these receivables including possible accessory claims or fees have been sold and assigned (notice of assignment). LogPay is a third-party beneficiary of the following provisions. It is, in addition, authorized to affect the collection of the payment due in its own name and on its own account.
2. Purchase Process
(1) In order to purchase MobileTickets in the ticket shop of MVV GmbH, the customer has to provide the correct details regarding the following points in either German or English:

(2) MVV GmbH shall not assume any liability whatsoever for the availability of the ticket shop for purchasing MobileTickets.
3. Purchasing and using MobileTickets
(1) By ordering a MobileTicket, the customer is submitting an offer to conclude a sales contract. The order is placed by clicking on the "Order now" button in the MVV Ticketshop on the website www.ride-ticketing.de/mvv-tickets. The sales contract shall materialize between the customer and MVV GmbH. The contract is concluded by returning an email as purchase confirmation by MVV GmbH. The purchase price is due immediately. The transportation agreement shall materialize with the transport company whose means of transport is being used in each case.
(2) The tickets that are offered via this distribution channel and the amount of the purchase price are specified on the Internet at www.mvv-muenchen.de/en. The amount of the purchase price for the MobileTicket can be seen from the respective applicable conveyance and tariff provisions of the MVV common fare system for the Greater Munich Area.
(3) The payment needs to be made to the financial service provider. Any telecommunications costs incurred during the ordering process and the use of the MobileTicket are to be borne by the customer.
(4) Unless it bears an exact period of validity, the MobileTicket entitles the holder to commence a journey immediately. The MVV common fare system for the Greater Munich Area applies. The customer needs to purchase the MobileTicket prior to commencing the journey and, if applicable, before passing through the platform barrier, and make sure that he or she has obtained a valid MobileTicket. Ultimately the database entry with the IT service provider is pertinent for the validity of the MobileTicket.
(5) The MobileTicket is not transferable to other persons and is only valid in conjunction with a valid ID or other means of identity verification for the individual specified on the ticket. In the case of group journeys, the individual specified on the ticket always must travel with the party.
(6) The ticket is issued as a MobileTicket and can also be stored in the device’s Wallet. The customer must be able to present the ticket on the device or in the Wallet at any time.
(7) A MobileTicket and valid ID or other means of identity verification are always to be carried during the journey or in the stations for surveillance purposes and shown to the inspectors upon request. Should the customer not be able to present a MobileTicket when the tickets are inspected (e.g. due to technical faults or an empty battery, etc.), the journey shall, in accordance with the provisions of the MVV common fare system for the Greater Munich Area, be considered a journey without a valid ticket. In the event of the ticket not being available, or faulty or erroneous transmission of the MobileTicket, the customer is obliged to purchase a valid ticket elsewhere prior to commencing the journey. (8) If presenting the MobileTicket retrospectively in the event of a complaint, the "General Terms and Conditions of Conveyance, Tariff Provisions and Fares" of the MVV common fare system for the Greater Munich Area (MVV-Gemeinschaftstarif), Sec. 9 (3) apply.
(9) Reimbursement and return of MobileTicket is excluded.
4. No right of revocation or return
The customer shall have no right of revocation or right of return regarding the MobileTicket purchased, since, under Sec. 312 (8) German Civil Code (BGB), the regulations for mail order contracts do not apply to contracts regarding the carriage of passengers. Purchased MobileTickets cannot be returned, revocated or cancelled, since they might be used multiple and/or might be valid immediately.
5. Blocking/Exclusion from Purchase
(1) MVV GmbH shall be entitled to effect extraordinary termination of the customer account, with immediate effect, if

6. Market Research and Prize Draw
(1) Before completing the purchase, all buyers are asked whether they would like to participate in a survey analyzing the popularity of the distribution channel and thereby in a prize draw. Participation is voluntary and not a requirement for purchase. Consent is given by actively checking a box during the purchase process.
(2) If the customer agrees to participate, first and last name and email address are forwarded to the commissioned market research institute. The customer will be informed by email about the next steps.
(3) All customers who participate in the research are automatically entered into a prize draw. Only people over 18 are eligible. Employees of MVV GmbH, involved service providers and the research institute and their relatives are excluded.
(4) Participation is possible between 01.09.2025 and 15.10.2025. One “Apple iPad® (A16)” (main prize) and ten official Oktoberfest™ collector mugs 2025 will be raffled. Each participant can win a maximum of one of the eleven prizes. The winners will be determined after the participation period and notified by email. Prizes will be sent by post.
(5) As part of the price draw, we process personal data that the customer voluntarily provides to us (name, e-mail address). This data is used exclusively for the purpose of running the competition and notifying the winners.
(6) Your personal data will be processed on the basis of your consent in accordance with Art. 6 para. 1 lit. a GDPR. Your data will only be stored for the duration of the competition and for subsequent notification of winnings. The data will then be deleted, unless statutory retention obligations prevent this.
(7) Customers have the right to withdraw the consent to data processing at any time with effect for the future. The revocation can be sent by e-mail to datenschutz@mvv-muenchen.de. After revocation, the data will be deleted, unless there are statutory retention obligations.
(8) MVV GmbH and the companies involved cannot be held liable for any damages or losses in connection with the prize draw.
(9) Legal recourse is excluded. The decisions of the organizer are final.
7. Methods of payment and invoicing
(1) In addition to the terms described above, the following regulations apply for the payment of a ticket. All payment methods shall be available to persons over the age of 18 having full legal capacity.
(2) The customer may select from various payment methods for orders at the ticketshop:
Other methods of payment are excluded. The customer shall not have the claim to participate in one of the mentioned payment methods.
8. Collection
The amount due is collected by LogPay via the direct debit procedure within the next five (5) bank working days. The debit of the account or the credit card is dependent on the processing of the customer’s payment service provider.
9. Payment by Apple Pay, Google Pay and PayPal
(1) For payment via Apple Pay, it is necessary that the customer has added a mean of payment to his Apple Wallet. In order to pay via Apple Pay, the customer selects Apple Pay as payment method within the MVV-App. Before paying, the customer can check his order once again. To initiate the payment, the customer must confirm the purchase. After the successful payment, the customer will receive the ticket via the MVV-App, otherwise an error message is displayed.
(2) For payment via Google Pay, it is necessary that the customer has added a mean of payment in his Google Wallet. In order to pay via Google Pay, the customer selects Google Pay as payment method within the MVV-App. Before paying, the customer can check his order once again. To initiate the payment, the customer must confirm the purchase. After the successful payment, the customer will receive the ticket via the MVV-App, otherwise an error message is displayed.
(3) To pay via PayPal, the customer selects PayPal as the payment method. The customer is then taken to PayPal's page, where the necessary information is entered. If the customer is not registered, the customer confirms the payment. If the customer is registered, the customer enters into a billing agreement with LOGPAY, under which the amount due is charged to the customer's PayPal account. The offer to purchase made by a non-registered or registered customer can only be accepted if the charge to the customer's PayPal account is successfully made. The customer will receive notice that the transaction has been either confirmed or declined.
(4) The LogPay system checks the data given by the customer for its accuracy and any blocking endorsements made by the respective credit card issuer. For this purpose, the customer's personal details are passed on to the companies listed under "Data Privacy". The customer hereby declares that he or she agrees with the latter. If the customer is not the owner of the indicated credit card, he/she ensures that the owner agrees with the charge. Furthermore, the customer is obliged to ensure that the indicated credit card is not disabled and that there is a sufficient limit. Should the authorization of the transaction fail for any reason, an error message is displayed.
(5) The date on which the amount is debited from the customer's account is determined by the customer's respective credit card agreement with his or her payment service provider.
(6) The customer must ensure that the amount can be withdrawn from the payment card. Should the customer unjustifiably cause a chargeback of the amount or should the collection fail for reasons caused by the customer, the payor shall be obliged to ensure that there are adequate funds in the account or that the reason for the failed payment is remedied, so that, in addition to the outstanding amount, any third-party fees of the bank incurred, can be collected on the day stated in the reminder. (7) The receivables resulting from ordering tickets shall appear on the customer's card statement of his or her payment service provider as an overall amount in euros.
10. Liability of the transport companies and service providers involved in selling Mobile-/ OnlineTicket
(1) In order to use MobileTickets it is necessary to utilize technical facilities and services of third parties. The transport companies, MVV GmbH and its service providers do not assume any liability or provide any warranty regarding terminals, software programs, transmission channels or telecommunications and other services of third parties. They do not assume any liability for erroneous or failed transmission of the ticket if the fault does not fall within their respective sphere of responsibility.
(2) All correspondence is to be directed to MVV GmbH.
11. Misuse and Payment Disruption
(1) If the customer notices misuse, he or she shall be obliged to report the latter without delay via kundendialog@mvv-muenchen.de or the MVV customer service telephone support. Until such time as the matter is reported the customer shall be liable for the liabilities incurred up to that time.
(2) Should a transport company or service provider detect misuse, the customer/the ticket will be blocked immediately. The blocking notification will be sent by the IT service provider via e-mail. Any ticket purchase or use of services made with the customer's data the latter will be deemed to have been ordered by the customer until such time as the account is blocked.
(3) In the event of a payment problem of any kind, regardless of the method of payment opted for, the customer's payment method will be blocked, until the claims to payment have been settled. In such a case, the customer shall be informed about the blocking by the financial service provider, by means of a formal reminder. In such a case, costs may be incurred by the customer, such as reminder fees.
12. Data privacy
12.1 Processing of e-payment services and receivables management
(1) In order to process the e-Payment services (e.g. webshop, mobile app) MVV GmbH uses the services of the IT service provider Digital H GmbH, Oststraße 55, 40211 Düsseldorf, as well as the financial service provider LogPay Financial Services GmbH Schwalbacher Straße 72, 65760 Eschborn. The technical operation of the software components is delegated to Digital H GmbH. All infrastructure is installed in certified data centers within the European Union. As part of commissioned data processing, the service providers use software instances of Amazon Web Services (AWS). The operation of these components takes place exclusively at servers located at Frankfurt am Main (Germany).
(2) The personal data provided by the customer (first and last name, email address, selected payment method) as well as data regarding the ticket purchases of the customer (order data, if necessary IP address and client, log data) and all changes are passed on to LogPay Financial Services GmbH for the purpose of the sale and assignment of the claims against the customer in connection with the ticket purchase. This is done on the legal basis of art. 6 sect. 1 sentence 1 lit. f GDPR. The legitimate interest of MVV GmbH is the outsourcing of the payment process and the receivables management. The legitimate interest of LogPay Financial Services GmbH is the processing of data for the purposes of handling payments, receivables management, the assessment of permissibility of payment methods and the prevention of payment defaults. The offer to conclude a sales contract for a ticket is only accepted if LogPay Financial Services GmbH acquires the resulting claim from the ticket sale. If LogPay Financial Services GmbH rejects the purchase of the claim, the offer to conclude a sales contract will be rejected. The information regarding data protection of LogPay Financial Services GmbH can be accessed on www.logpay.de/DE/datenschutzinformationen/. In addition, MVV GmbH processes your personal data having received from LogPay Financial Services GmbH (information about the decision whether the claim is acquired or not). Without providing the data, the MobileTicket cannot be used.
(3) In case the customer fails to meet his or her payment obligations, the personal details are passed on to a debt collection agency for the purpose of the collection of the receivables (for example with a payment reminder) and the enforcement of the receivables (for example through legal default actions or the cooperation with a law firm in case of a legal enforcement).
12.2 Customer Service
MVV GmbH may use and store the personal data of registered customers for the purpose of customer service and pass them on to their service providers for the clarification of questions; the personal data are not used for advertising or other purposes without the prior explicit consent of the customer. This is done based on 6 sect. 1 sentence 1 lit. b GDPR, for fulfilment of the MobileTicket contract. Without providing the data, the MobileTicket cannot be used.
12.3 Inspection of MobileTickets
For securing the revenues, the transport companies involved in the transport association may - on request - inspect the ticket data, the information stored in the barcode (masked last name, masked first name and date of birth of the ticket holder) and the control medium (e.g. personal ID) provided by the customer. This is done based on art. 6 sect. 1 sentence 1 lit. f GDPR. The legitimate interest of MVV GmbH and the transport companies is the securing of fares. Personal data are not stored on the control device, but only displayed. In the event of an objection to a ticket inspection, personal data may be forwarded to the transport company that oversees further processing. Without providing the data, the MobileTicket cannot be used.
12.4 General privacy policy
(1) The personal data collected by MVV GmbH or by its service providers will be deleted when the purpose of the data collection (sale of MobileTickets) does no longer exist and no legal retention periods are opposed. The account information of a customer, who has not made any ticket purchases, will be erased, at the latest, after a period of two years. The account information of a customer who has made ticket purchases will be deleted ten years after the last purchase at the latest. The order data are treated as a receipt and are stored according to legal retention periods, then they are deleted. Apart from that, a cancellation of personal data can be carried out if a customer explicitly requests it by sending an email to kundendialog@mvv-muenchen.de and given that no legal retention periods are opposed. In this case, the deletion is carried out within a maximum period of 60 days.
(2) As long as the processing of personal data is based on the consent of the customer, there is a right to revoke the consent at any time, without affecting the legality of the processing carried out based on the consent until the revocation, in accordance with the legal regulations on data protection (art. 7 GDPR, § 51 BDSG).
In case of processing of personal data to carry out tasks in the public interest (Art. 6 Sect. 1 Sentence 1 lit. e GDPR) or to safeguard legitimate interests (Art. 6 Sect. 1 Sentence 1 lit. f GDPR), the customer can object to the processing of personal data concerning her or him at any time with effect for the future. In case of an objection, the MVV GmbH refrain from any further processing of the affected data for the aforementioned purposes, unless,
There is a right to information on the personal data concerned (art. 15 GDPR) as well as to rectification (art. 16 GDPR) or cancellation (art. 17 GDPR) or to restriction of processing (art. 18 GDPR) or a right of objection to the processing (art. 21 GDPR) and a right to data portability (Article 20 GDPR) in accordance with the legal regulations on data protection. The customer can assert these rights by sending an e-mail to kundendialog@mvv-muenchen.de.
(3) The responsibility for data protection according to legal regulations is in the hands of MVV GmbH, represented by the management. (4) According to art. 77 GDPR, irrespective of any other administrative or judicial remedies, the customer has the right to lodge a complaint with a supervisory authority, in particular in the Federal State of his or her residence, place of work or place of the suspected violation, if the customer considers that the processing of his or her personal data has violated the General Data Protection Regulation.

13. Final provisions
(1) Exclusively the law of the Federal Republic of Germany shall apply, subject to exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). In so far as the customer is a merchant or has his or her place of residence outside Germany, Munich is agreed upon as the exclusive place of jurisdiction.
(2) Should a provision of these General Terms and Conditions of Business be or become invalid, in whole or in part, the validity of the remaining provisions of the agreement in its entirety shall not be affected thereby.
